By accessing or using TutorCore ('Platform', 'we', 'us', 'our'), operated by Mike Zechnas, you ('User', 'Student', 'you') agree to these Terms & Conditions in full. If you disagree with any part of these Terms, you must not use the Platform.

Your acceptance is confirmed when you:

• ▸Click 'I Agree to the Terms & Conditions' during signup
• ▸Access, use, or pay for any TutorCore service

These Terms apply to all users including Free, Pro, Team, and Enterprise subscribers. Continued use of the Platform after any modifications constitutes acceptance of the updated Terms.

2.1 What TutorCore Provides

TutorCore is an AI-powered English language learning platform designed for Spanish-speaking professionals and learners. Our services include:

• ▸Structured lessons across four levels: Beginner, Intermediate, Advanced, and Professional
• ▸AI-powered tutoring chatbot for real-time conversation practice
• ▸Pronunciation and vocabulary games
• ▸Progress tracking, XP system, and achievement streaks
• ▸Access to educational materials, exercises, and assessments

2.2 Subscription Tiers

• ▸Free: Access to Beginner-level content and limited AI Tutor interactions
• ▸Pro: Full access to all lessons, unlimited AI Tutor, and all games
• ▸Team: Up to 5 members, all Pro features, team management dashboard
• ▸Enterprise: Custom team size, dedicated support, and advanced analytics

2.3 Service Availability

TutorCore aims for 99.5% uptime but does not guarantee uninterrupted access. We may temporarily suspend access for scheduled maintenance, emergency security updates, or events beyond our reasonable control.

3.1 Eligibility

You must be at least 18 years old to create a TutorCore account independently. Users aged 13–17 may register only with verifiable parental or guardian consent. TutorCore is not directed at children under 13.

3.2 Account Responsibility

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized access at hello@tutorcore.com.

3.3 One Account Per User

Each user is permitted one account. Creating duplicate accounts to circumvent restrictions or abuse promotions may result in permanent suspension of all associated accounts.

4.1 Pricing & Currency

All prices are in US Dollars (USD). Prices may change with 30 days' advance notice to active subscribers.

4.2 Payment Processing

Payments are processed securely via PayPal and authorized payment processors. TutorCore does not store your full payment card details.

4.3 Subscription Billing

• ▸Subscriptions renew automatically on a monthly or annual basis
• ▸You will receive a billing reminder 3 days before renewal
• ▸Failed payments result in a 5-day grace period before access is downgraded

5.1 Cancellation

You may cancel your subscription at any time from Account Settings. Cancellation takes effect at the end of the current billing period. No partial-month refunds for mid-cycle cancellations unless required by law.

5.2 7-Day Money-Back Guarantee

First-time Pro subscribers are eligible for a full refund if requested within 7 days of the initial purchase, provided no Terms violations occurred. Email hello@tutorcore.com with your account email and order details.

5.3 Non-Refundable Situations

• ▸Requests made after 7 days of purchase
• ▸Subscription renewals or plan upgrades
• ▸Team or Enterprise fees after onboarding is complete
• ▸Accounts suspended for Terms violations
• ▸Technical issues caused by user's device or internet connection

6.1 Permitted Use

TutorCore grants you a limited, personal, non-transferable license to access the Platform for your own English language learning.

6.2 Prohibited Conduct

• ▸Share, resell, or distribute access to TutorCore
• ▸Reverse engineer, scrape, or extract Platform content or code
• ▸Use bots or automated tools to interact with the AI Tutor
• ▸Upload harmful, illegal, or offensive content
• ▸Attempt to bypass payment systems or tier restrictions
• ▸Impersonate TutorCore, Mike Zechnas, or other users
• ▸Use TutorCore for commercial tutoring without written permission
• ▸Engage in harassment or abuse of other users or staff

All content on TutorCore — including lessons, audio, exercises, games, graphics, software, and the AI Tutor system — is the exclusive intellectual property of TutorCore / Mike Zechnas, protected by copyright and applicable law.

You receive a limited, non-exclusive license to access content for personal educational use during your active subscription. You may NOT share, distribute, record, or resell any Platform content.

8.1 Data We Collect

• ▸Account info: name, email, hashed password
• ▸Profile data: username, display name, subscription tier
• ▸Learning data: lesson progress, XP, streaks, game scores
• ▸Usage data: features used, session durations
• ▸Payment data: processed by PayPal — we do not store card numbers

8.2 Your Rights

• ▸Access: request a copy of your personal data
• ▸Correction: update data via Account Settings
• ▸Deletion: email hello@tutorcore.com
• ▸Portability: request data in machine-readable format
• ▸Opt-out: unsubscribe from marketing emails anytime

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TUTORCORE SERVICES ARE PROVIDED 'AS IS' WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE:

• ▸Uninterrupted or error-free access to the Platform
• ▸Specific learning outcomes, exam results, or career advancement
• ▸Accuracy of all AI-generated content

Results depend entirely on individual effort, consistency, and prior knowledge.

TO THE FULLEST EXTENT PERMITTED BY LAW, TUTORCORE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM.

Our total liability for any claim shall not exceed the greater of: (A) the amount you paid to TutorCore in the 3 months preceding the claim, or (B) $50 USD.

You agree to defend, indemnify, and hold harmless TutorCore and Mike Zechnas from any claims, damages, or expenses (including legal fees) arising from your violation of these Terms, misuse of the Platform, or violation of any applicable law.

12.1 By You

You may delete your account via Account Settings or by emailing hello@tutorcore.com. Your data will be removed within 30 days.

12.2 By TutorCore

We may suspend or terminate your account if you violate these Terms, provide false information, engage in fraud, or attempt to compromise Platform security. Termination for cause forfeits all paid fees with no refund.

TutorCore may update these Terms at any time. Active subscribers will be notified by email at least 14 days before changes take effect. Continued use after the effective date constitutes acceptance.

14.1 Informal Resolution

Before pursuing legal action, both parties agree to attempt good-faith resolution by emailing hello@tutorcore.com. We will respond within 10 business days.

14.2 Governing Law

These Terms are governed by the laws of the Dominican Republic. You agree to submit to the exclusive jurisdiction of courts located in the Dominican Republic.

14.3 Limitation Period

Any claim must be filed within one (1) year of the event giving rise to the claim.
